Important: Please read these Terms of Service carefully before using Clean up. By using the app, you agree to be bound by these terms.

1. Acceptance of Terms

By downloading, installing, or using Clean up ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

Download and install the App on iOS devices that you own or control
Use the App for personal, non-commercial purposes

3. License Restrictions

You agree NOT to:

Copy, modify, or create derivative works of the App
Reverse engineer, decompile, or disassemble the App
Remove, alter, or obscure any proprietary notices on the App
Use the App for any illegal or unauthorized purpose
Sell, rent, lease, or sublicense the App
Use the App in any way that could damage, disable, or impair the App

4. User Responsibilities

4.1 Data Backup

IMPORTANT: You are solely responsible for backing up your photos and contacts before using the App's deletion features. We strongly recommend creating a backup before deleting any data.

4.2 Proper Use

You agree to:

Use the App in accordance with all applicable laws and regulations
Review deletion suggestions carefully before confirming
Understand that deleted photos go to iOS "Recently Deleted" for 30 days
Not rely solely on the App for critical data management decisions

5. App Functionality

5.1 Features Provided

The App provides the following features:

Duplicate photo detection using perceptual hashing
Similar photo detection and grouping
Screenshot identification and cleanup
Duplicate contact detection (optional)
Storage analysis and visualization

5.2 Accuracy

While we strive for accuracy, the App:

May not detect all duplicates or similar items
May occasionally identify non-duplicates as duplicates
Relies on algorithms that may not be 100% perfect
Should be used with human review and judgment

6. Permissions and Access

6.1 Required Permissions

The App requires access to:

Photo Library: To analyze and manage your photos (required for core functionality)
Contacts: To detect duplicate contacts (optional feature)

6.2 Permission Control

You can:

Grant limited or full photo library access
Revoke permissions at any time through iOS Settings
Choose not to use contact-related features

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties, express or implied, including but not limited to:

Warranties of merchantability
Fitness for a particular purpose
Non-infringement
Accuracy or completeness of results
Uninterrupted or error-free operation

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We shall not be liable for:

Any indirect, incidental, special, consequential, or punitive damages
Loss of data, including photos or contacts
Loss of profits or revenue
Loss of use or opportunity
Damages resulting from incorrect detection or deletion

Our total liability shall not exceed the amount you paid for the App (if any), or $10 USD, whichever is greater.

9. Indemnification

You agree to indemnify and hold harmless Clean up and its developers from any claims, damages, losses, or expenses (including legal fees) arising from:

Your use or misuse of the App
Your violation of these Terms
Your violation of any third-party rights
Any data loss resulting from your use of the App

10. Subscription Services

10.1 Premium Features

The App offers premium features through subscription plans, including:

Unlimited photo scans and deletions
Advanced blur detection
Priority processing
Ad-free experience
Additional features as they become available

10.2 Subscription Plans

We offer the following subscription options:

Weekly Premium: Charged weekly with a free trial period
Yearly Premium: Charged annually at a discounted rate

Subscription prices are displayed in the App and may vary by region. All prices include applicable taxes.

10.3 Free Trial

New subscribers may be eligible for a free trial period (typically 3 days for weekly plans). You will not be charged during the free trial period. If you do not cancel before the trial ends, you will automatically be charged for the subscription.

Important: To avoid being charged, you must cancel your subscription at least 24 hours before the end of the free trial period.

10.4 Automatic Renewal

All subscriptions automatically renew unless you cancel at least 24 hours before the end of the current period. Your iTunes Account will be charged for renewal within 24 hours prior to the end of the current period.

10.5 Managing Subscriptions

You can manage and cancel your subscriptions through the App Store app.

10.6 Payment

Payment will be charged to your iTunes Account at confirmation of purchase. All payments are processed by Apple through the App Store.

11. Refund Policy

11.1 Refund Requests

All purchases and subscriptions are processed through Apple's App Store. We do not have the ability to issue refunds directly.

11.2 Apple Refund Process

To request a refund:

Visit reportaproblem.apple.com
Sign in with your Apple ID
Find the subscription or purchase
Click "Report a Problem"
Follow the on-screen instructions

11.3 Refund Eligibility

Refunds are subject to Apple's refund policies and are granted at Apple's sole discretion. Common reasons for refund requests include:

Accidental purchase
Technical issues preventing app use
Unauthorized purchase

Important: Refunds are typically not granted if you have used premium features during the subscription period. Please review features carefully before subscribing.

11.4 Cancellation vs. Refund

Please note:

Cancellation: Stops future charges but does not refund current period
Refund: Must be requested separately through Apple

12. Privacy

Your use of the App is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices regarding your data.

Key privacy points:

All analysis happens locally on your device
We do not collect or transmit your personal data
No photos or contacts are uploaded to our servers
Subscription data is managed by Apple, not us

13. Updates and Modifications

13.1 App Updates

We may:

Release updates to improve functionality or fix bugs
Modify or discontinue features at any time
Require you to update to continue using the App
Add or remove premium features with notice

13.2 Subscription Changes

We reserve the right to modify subscription prices for new subscribers. For existing subscribers:

Price changes will be communicated at least 30 days in advance
Changes take effect at your next renewal period
You may cancel before the price change takes effect

13.3 Terms Updates

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

Updating the "Last Updated" date
Displaying a notice in the App

Continued use of the App after changes constitutes acceptance of the modified Terms.

14. Termination

14.1 By You

You may terminate this agreement at any time by:

Canceling your subscription through iTunes/App Store
Uninstalling the App from all your devices
Ceasing all use of the App

14.2 Effect of Termination

Upon termination of your subscription:

You will retain access to premium features until the end of the current billing period
You will not receive a refund for the unused portion of your subscription
You will revert to the free version of the App
Some features may become limited or unavailable

14.3 By Us

We may terminate or suspend your access to the App if:

You violate these Terms
You use the App for illegal purposes
We discontinue the App
You engage in fraudulent activity

If we terminate your account for violation of Terms, you will not receive a refund for any remaining subscription period.

15. iOS and Apple Terms

This App is available through the Apple App Store. You acknowledge and agree that:

These Terms are between you and us, not Apple
Apple has no obligation to provide support for the App
Apple is not responsible for any claims related to the App
You must comply with Apple's App Store Terms of Service
Apple is a third-party beneficiary of these Terms
All subscription payments are processed by Apple
Subscription management is handled through your Apple ID
Refund requests must be made through Apple's systems

16. Intellectual Property

The App and all its contents, features, and functionality are owned by us and are protected by:

Copyright laws
Trademark laws
Other intellectual property rights

17. Export Control

You agree to comply with all applicable export and import laws and regulations. You may not use or export the App except as authorized by U.S. law and the laws of the jurisdiction in which the App was obtained.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.

19. Dispute Resolution

17.1 Informal Resolution

In the event of any dispute, you agree to first contact us to attempt to resolve the dispute informally.

17.2 Arbitration

20. Severability

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede all prior agreements and understandings.

22. No Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
